These Terms & Conditions ("Terms") apply to your use of the website calmcurve.in (the "Website") and to all purchases made on it. The Website is operated by CalmCurve ("CalmCurve", "we", "us", "our"). By using the Website or placing an order, you agree to these Terms. If you don't agree, please don't use the Website.

1. Eligibility

You must be at least 18 years old, or use the Website under the supervision of a parent or guardian, and be able to enter into a legally binding contract under the Indian Contract Act, 1872.

2. Our product and health information

  • CalmCurve is a personal comfort device that provides warmth and vibration massage. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease.
  • Information on the Website is for general information only and is not medical advice. If you have severe, unusual or persistent pain, please consult a doctor.
  • Consult a doctor before use if you are pregnant, have a pacemaker or other implanted device, have diabetes, poor circulation or reduced skin sensation, or have broken or sensitive skin in the area of use.
  • Always follow the user guide. Start on the lowest heat level, wear it over a thin layer of clothing, take breaks between sessions, and do not use it while sleeping. Not intended for use by children.
  • We try to show product images, colours and specifications as accurately as possible. Small differences in appearance, packaging or display may occur.

3. Prices and payment

  • All prices are in Indian Rupees (₹) and include applicable taxes unless stated otherwise.
  • We may change prices at any time. The price that applies is the one shown when you place your order.
  • Payments are processed securely by our payment partners. We do not store your card details.
  • If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund any amount paid.

4. Orders

  • Your order is an offer to buy. The contract is formed when we dispatch your order.
  • We may refuse or cancel an order if the product is unavailable, if there is a pricing or listing error, if we can't verify the order or delivery address, or if we suspect fraud or misuse (including repeated refused COD deliveries). If we cancel a prepaid order, we refund you in full.

5. Shipping, returns and refunds

Delivery is covered by our Shipping Policy. Returns, refunds, cancellations and our 30-day money-back guarantee are covered by our Return & Refund Policy. Both form part of these Terms.

6. Reviews and content you submit

If you send us a review, photo or other content, you confirm it is genuine and yours to share, and you allow us to use it on our Website and social media. We may remove content that is false, offensive or unlawful. We do not edit reviews to change their meaning.

7. Intellectual property

All content on the Website, including text, graphics, logos, images and design, belongs to CalmCurve or its licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.

8. Acceptable use

You agree not to misuse the Website, including attempting to gain unauthorised access, interfering with its operation, placing fraudulent orders, or using it for any unlawful purpose.

9. Limitation of liability

To the maximum extent permitted by law, CalmCurve is not liable for any indirect, incidental or consequential loss arising from your use of the Website or our products, including loss caused by using the product in a way that is not in line with the user guide. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019 or other applicable law.

10. Third-party services

The Website runs on Shopify and uses third-party payment, shipping and messaging providers. Their own terms and privacy policies apply to their services.

11. Privacy

How we collect and use your personal information is explained in our Privacy Policy.

12. Changes to these Terms

We may update these Terms from time to time. The version posted on the Website at the time of your order applies to that order.

13. Governing law and disputes

These Terms are governed by the laws of India. We'll always try to resolve any issue with you directly first. Subject to your rights as a consumer, the courts at New Delhi have jurisdiction over any dispute.

14. Grievance redressal

In line with the Consumer Protection (E-Commerce) Rules, 2020, you can raise any complaint with our Grievance Officer. We acknowledge complaints within 48 hours and aim to resolve them within one month.
